はじめに

BODYSONG.（以下「当社」といいます。）は、当社の運営するbodysongbodysong.com（以下「本サイト」といいます。）で提供するサービス（以下「本サービス」といいます。）の利用規約（以下「本規約」といいます。）を以下の通り定めます。

本規約の範囲及び変更
本規約は、本サービスの利用に際し、注文、登録並びに提供される情報やサービスをご利用される方（以下「利用者」といいます。）全てに適用されるものとします。

当社は、事前の予告なしに、また利用者の承諾を得る事なく、本規約を全部または一部を変更・更新できるものとします。

本規約が変更された場合、利用者は変更後の規約のみが適用されるものとします。

商品の注文
本サイトでのご注文は、利用者自身が注文を完了した場合に、当社と利用者の間で該当商品についての売買契約が成立したとみなします。従いまして、これ以降、利用者からの注文内容の変更やキャンセルはお受けできないものとします。尚、利用者の使用するデバイス等の利用状況によって注文完了の画面に移行されない場合もございますが、利用者のアカウントより該当商品のご注文の完了が確認できる場合、注文完了の画面に移行したとみなします。

ご注文が完了いたしましたら、当社よりご注文の確認のメールが自動配信されます。しかしながら、利用者のメールアドレスのセキュリティプログラム等の使用状況によって受信出来ない事もございますので、受信出来ない場合はCONTACTにお問い合わせいただき、注文が完了されているかどうかご確認ください。

本サイトでは掲載する商品の写真の色合い、デザイン等が現物と同じになるように極力しておりますが、利用者の閲覧される環境や機器によって、現物と異なる場合がございます。予めご了承ください。

在庫について、複数のお客様から同じ商品を同時にご注文いただいた場合など、例外的に商品の用意が出来ない場合があります。在庫が確保できなかった場合は、速やかに返金の対応をさせていただきます。（クレジットカード会社を通じての返金となりますので、クレジットカード会社の取扱いにより返金の時期が異なります。）

その他、本サービスの利用に関して、以下のいずれかに該当する場合または該当すると当社が判断した場合、当社は本売買契約の取り消し、解除、その他適切な措置を取ることが出来るものとさせていただきます。当社は、本売買契約の取り消しなどに伴い生じた損害、損失、不利益などについては、いかなる保証も行いません。

1）利用者が過去に本規約等に違反していることが判明した場合。2）利用者の情報に虚偽の表示、不備があることが判明した場合。3）利用者に生じる債務の履行が不確実である場合。4）利用者が不正な売買（転売等の営利目的での購入、第三者に成りすました購入等）を行った、もしくはそのように当社が判断した場合。

Ordering goods

Regarding inventory, we may not be able to prepare products in exceptional cases, such as when multiple customers order the same product at the same time. If we cannot secure the stock, we will promptly refund it. (Since refunds will be made through the credit card company, the timing of refunds will differ depending on the handling of the credit card company.)

In addition, regarding the use of this service, if any of the following applies or if the Company determines that it applies, the Company shall be able to cancel or cancel this sales contract or take other appropriate measures. .. 1) When it is found that the user has violated this agreement in the past.

支払い方法
商品等の支払い金額は、消費税を含む商品等の購入代金及び配送料の合計となります。

本サービスによって購入された商品等の支払いに関しては、利用者本人名義のクレジットカードによる支払いに限るものとします。

クレジットカードで支払われる場合は、会員がクレジットカード会社との間で別途契約する条件に従うものとします。なお、クレジットカードの利用に関連して、会員とクレジットカード会社等の間で何らかの紛争が発生した場合は、会員とクレジットカード会社との間で責任をもって解決するものとします。

method of payment

商品の発送
通常、注文確定日より5営業日以内（土日、祝祭日及び年末年始除く）に商品をヤマト運輸 / 佐川急便にて発送いたします。日時指定は出来ませんので予めご了承ください。

一度の注文毎の発送になります。複数回に分けて注文された場合、同一の配送先であっても、まとめての発送はできません。予めご了承ください。

配送途中における商品の損害、紛失に関して当社はいかなる責任も負わないものとします。

利用者都合（長期不在や住所記載間違い、受け取り拒否等）による注文品の配達未完遂の場合や、配送会社における荷物保管期限(配送日より約7日間)を経過してもお受け取りいただけない場合は、一度確認の為、利用者にご連絡いたします。ご連絡のつかない場合は、当該注文の取消等の処理をさせていただきます。また、今後の注文の受付をお断りさせていただく場合もございますので、ご了承ください。

The Company shall not be liable for any damage or loss of the product during delivery.
When the delivery of the ordered item is not completed due to user's convenience (long-term absence, incorrect address entry, refusal to receive, etc.). / If you do not receive the parcel after the package storage deadline (about 7 days from the delivery date) at the delivery company. / We will contact the user for confirmation once.
If you cannot contact us, we will process the order, such as canceling it. In addition, please note that we may refuse to accept future orders.

商品の返品・交換について
本サービスにて利用者が注文した商品の返品（返金）や交換は受け付けておりません。

但し、商品に瑕疵があった場合、誤送のあった場合にのみに限り交換を受け付けます。またその場合、以下の項目の条件を全て満たしていることとします。

1）商品到着後7日以内に当社宛てに当サイトCONTACTより連絡する事。2）未使用品且つタグ付きである事。3）付属品、納品書がある事。

当社に連絡後、利用者は該当の商品、タグ、付属品、納品書を同封の上、着払いにて返送して下さい。当社にて返送品を確認の上、該当の商品に瑕疵がある、あるいは誤送とみなされた場合、商品を正しいものと交換させていただきます。その際、他の商品や色、サイズに変更することは出来ません。

商品の在庫が無く、該当の商品が用意できなかった場合にのみ、返品（返金）の対応をさせていただきます。

また、当サイトからの注文では無く店舗での購入の場合、返品、交換の対応は購入先での対応とさせていただきます。

About product returns and exchanges

免責事項
以下の場合に、発生する通信回線やコンピューターなどの障害によるシステムの中断、遅滞、中止、データ消失ならびにデータへの不正アクセス、コンピューターウイルス等による各種障害によって発生する損害については、当社は一切責任を負いません。1）火災、地震、洪水、落雷、大雪等の天変地異が生じた場合。2）戦争、内乱、テロ、暴動、騒乱等の社会不安が生じた場合。3）当社が契約している電話会社、運送会社またはプロバイダーから適切なサービスをうけられなかった場合。4）当社が技術的に対応不可能な事由が生じた場合。

禁止行為
本サービスの利用にあたり、利用者に対し以下の行為を行うことを禁止致します。

なお、利用者による以下の行為が判明した場合は、当社の判断により利用者からの発注済の注文の解約ならびに今後の本サービスのご利用をお断りすることがあります。

また、そのような禁止行為判明により当社または善意の第三者に損害が生じた場合は、その利用者が発生した損害を全て自身の負担、責任により賠償する責務を負うものとします。

1）公序良俗に反する行為、その他法令に違反する行為、ならびにそのおそれのある行為。2）本サービスの利用開始にあたって虚偽申告を行う行為。3）本サービスを商業目的で利用する行為。4）本サービスを通じて入手したコンテンツを、複製、販売、出版、頒布、公開およびそれらに類似する行為。5）本サービスを利用するに当たり、当社ならびに第三者に関するすべての知的財産権を侵害する行為、ならびにそのおそれのある行為。6）本サービスならびに関連システムを不正利用することによる、当社ならびに第三者の情報を意図的に搾取悪用、消去、改ざんを行う行為。7）その他、前述に拘わらず当社が不法、不適当、不合理であると判断する行為。

Banned acts
When using this service, it is prohibited to perform the following acts on the user.

アカウントについて
本サービスを利用して注文するには、当社所定の方法に従い、アカウントを作成する必要があります。

当社は、新規アカウント作成の場合、完了した時点で登録を承認するものとします。未成年者は、適格な法定代理人の事前の同意がなければ、アカウント作成をすることができないものとします。未成年者のアカウントにより商品の注文があった場合には、保護者の同意を得たものとします。利用者はパスワードを含む本アカウント情報を厳重に管理・保管する責任を負うものとし、第三者に譲渡、売買、承継、貸与、開示又は漏洩してはならないものとします。利用者は、利用者の本アカウントおよび本アカウントを通じて発生するすべての活動に関して、秘密性およびセキュリティの保持に係る単独の責任を有するものとし、利用者は、利用者の本アカウントの安全性に係る問題について、即時に当社に対して通知を行うことに同意されたものとします。当社は、利用者の本アカウントの不正な利用に起因する損害について、一切の責任を負いません。
当社は、以下の各号の何れかに該当する場合、当該登録を承認しないものとします。

1） 会員登録の希望者が、過去に当社の提供する何らかのサービスに関する本規約に違反したこと等により、会員登録の抹消等の処分を受けていたことが判明した場合。2） 会員登録の希望者の申請内容に虚偽の事項が含まれていることが判明した場合。3） 会員登録の希望者が、過去に当社の提供する何らかのサービスに関して、料金等の支払いを履行していない場合、又は、正当な理由なく長期間に亘る商品等の受取り不能、返品・交換の拒絶その他の債務不履行があったことが判明した場合。4） 過去に本規約（禁止事項）の行為を行ったことが判明した場合。5） その他登録を承認することが本サービスの運営・管理上、不適当であると当社が合理的に判断する場合

アカウントの削除希望の利用者は、いつでも削除できるものとします。当サイトCONTACTよりご連絡ください。利用者のアカウントは、当社が削除申請を受領した時点で資格を喪失するものとします。

About the account

1) When it is found that the applicant for membership registration has been punished such as cancellation of membership registration due to violation of this agreement regarding some services provided by the Company in the past.

2) When it is found that the application contents of the applicant for membership registration contain false matters.

3) If the applicant for membership registration has not paid the fees, etc. for any service provided by the Company in the past.When it is found that there has been a long-term non-receipt of goods, refusal of returns or exchanges, or other defaults for a long period of time without a justifiable reason.

4) When it is found that the act of this agreement (prohibited matter) has been performed in the past.

5) When we reasonably judge that it is inappropriate for the operation and management of this service to approve other registrations.

個人情報の取り扱い
本サービスの利用に関連して当社が知り得た会員の個人情報については、当社は別途当社が定める「個人情報保護方針」に従い取り扱うものとします。

知的財産権、著作権
本サービスを通じて提供されるコンテンツの知的財産権は、全て当社に専属的に帰属するものとします。

目的の如何を問わず、当社のコンテンツの無断複製、無断転載その他の無断二次利用行為等の国内及び国外の著作権法及びその他の法令により禁止される行為が発見された場合には、当社は直ちに法的措置をとるものとします。

本規定に違反して第三者との間で何らかの紛争が生じた場合、利用者はその責任と費用において、かかる紛争を解決するとともに、当社に何らの損害、損失又は不利益等を与えないものとします。

Intellectual property rights, copyright

準拠法及び管轄裁判所
本サイトの利用または商品の売買契約に関しては日本法を準拠法とし、当社と利用者との間で本規約につき、訴訟の必要性が生じた場合は、東京地方裁判所を専属的合意管轄裁判所とするものとします。

Governing law and court of jurisdiction
Japanese law shall be the governing law regarding the use of this site or the sales contract of products.
If there is a need for a proceeding regarding this agreement between the Company and the user, the Tokyo District Court shall be the exclusive agreement jurisdictional court.
